The
writer talks about the problems with the laws that have been implemented to
protect women from sexual harassment at the workplace. She takes us back to the
Vishaka judgement and throws light on how the guidelines that were set under
this case are flawed. The author tells us that the laws are not actually
helping curb sexual harassment in the work place, not exactly how it should,
rather its reinforcing on Indian values and how a woman should conduct herself.
Directly or indirectly its discriminatory towards women at various levels. It
actually feels bad reading the truth about these laws, how the laws that are
meant to protect us actually first judge you on your character and morals and
how you dress and carry yourself. ‘The test of reasonableness’ who
decides whats reasonable, who decides if the woman was ‘asking for it’.
Woman
have been oppressed throughout decades, we have been told what to wear, how to
eat, how to sit, how to talk. Its shameful on the part of the judiciary to be
coming up with such guidelines and letting the defense attorney question a
woman’s morals and integrity. After all that the women have been through, laws
like these bring us back to square one and makes us question when will women
ever be treated equal to men.
